It has been my understanding that the FDA was only able to regulate sales by the manufacturers, and the manufacturers regulate their dealers to ensure their sales are only going to.mil or LEO, but if you found one for sale by an individual used or otherwise, there was no law preventing that type of sale. IMHO, this interpretation is supported by the fact that these lasers are being sold on eBay, the FDA is aware of it, but the have not instructed eBay to not allow these sales.
